1. Introduction
By placing an order and paying a deposit, you (the customer) agree to the following terms and conditions. Please read them carefully before making a purchase.
2. Unique and Non-Refundable Items
2.1. All items sold are custom-made, unique, and tailored to your specific requirements.
2.2. Due to the personalized nature of our products, all sales are final. No refunds or exchanges will be offered once the order is placed and the deposit is made.
2.3. As our products are custom-made to your specifications, the 14-day cooling-off period under the Consumer Contracts Regulations 2013 does not apply.
3. Deposit and Payment
3.1. A 20% deposit is required to confirm your order. This deposit is non-refundable, except in circumstances where we fail to fulfill our obligations under this contract.
3.2. By making a deposit, you confirm your understanding and acceptance of these terms and conditions.
3.3. The remaining balance must be paid in full prior to collection or delivery of the item(s).
4. Collection and Delivery
4.1. Due to the nature of our work, items will never be posted.
4.2. Collection of the item(s) can be arranged once the item is completed and the remaining balance is paid.
4.3. If delivery is required, it can be arranged on a case-by-case basis, and any additional delivery charges will be your responsibility. Delivery times will be arranged after the item is finished.
5. Turnaround Time
5.1. The turnaround time for each order is flexible and subject to change depending on the complexity of the item, material availability, and other factors.
5.2. We will provide an estimated completion date, but this may change. You will be notified of any changes to the timeline.
6. Inspection of Goods
6.1. You are required to inspect the item(s) upon receipt.
6.2. Any issues, defects, or concerns with the product must be reported within 24 hours of receipt.
6.3. If no concerns are raised within this period, the item(s) will be deemed accepted, and no further claims can be made regarding the condition of the item(s).
7. Use of Images
7.1. By placing an order, you grant us permission to photograph both the process in the studio and the finished product(s) and use these images for promotional purposes, including but not limited to social media, website content, and other marketing materials.
7.2. You also grant permission for us to photograph any unique features of the cast, including but not limited to, detailed rings and other items casted.
7.3. Your name or other personal details will not be disclosed without explicit consent.
7.4. We will not photograph any customer without prior consent.
8. Limitation of Liability
8.1. Our liability for any losses or damages arising out of your use or purchase of our products is limited to the fullest extent permitted by law.
8.2. We will not be liable for any indirect, incidental, or consequential damages.
8.3. We are not responsible for any damage or loss caused by circumstances outside our control, including but not limited to delays caused by third-party suppliers, transportation, or unforeseen events.
9. Returns and Refunds
9.1. Due to the bespoke nature of our products, all sales are final, and no refunds or exchanges will be provided.
9.2. In the unlikely event that a product is defective, you must notify us within 24 hours of receipt for an inspection.
9.3. If a product is deemed faulty due to our workmanship, we will work with you to resolve the issue, which may include repair or replacement (where applicable), at our discretion.
10. Privacy and Data Protection
10.1. We are committed to protecting your privacy and data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
10.2. The personal data collected (such as name, contact details, and payment information) will only be used for processing your order, fulfilling our contract, and marketing purposes if consent is given.
10.3. We will never share or sell your data to third parties without your consent, except as required by law or in the course of fulfilling your order (e.g., delivery services).
10.4. You have the right to request access to your personal data, ask for corrections, or request the deletion of your data at any time by contacting us.
10.5. The legal basis for processing your data is the performance of a contract and, where applicable, your consent for marketing communications.
10.6. We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.
10.7. You have the right to lodge a complaint with the Information Commissioner's Office if you believe we have not handled your data in accordance with the law.
11. Amendments to Orders
11.1. Once an order is placed, no changes can be made to the design or specifications without approval, which may result in additional charges and extended lead times.
12. Amendments to Terms
12.1. We reserve the right to amend or update these terms and conditions at any time. The latest version of these terms will apply to all future orders.
13. Governing Law and Jurisdiction
13.1. These terms and conditions are governed by and construed in accordance with the laws of England and Wales.
13.2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.
14. Severability
14.1. If any provision of these terms is found to be invalid or unenforceable by a court, the remaining provisions shall continue in full force and effect.
15. Dispute Resolution
15.1. In the event of any dispute or claim arising out of or in connection with these terms and conditions, both parties agree to attempt to resolve the matter amicably through negotiation before pursuing legal action.
15.2. If a dispute cannot be resolved through negotiation, either party may refer the matter to an independent mediator before pursuing legal action.
16. Statutory Rights
16.1. These terms and conditions do not affect your statutory rights under the Consumer Rights Act 2015.
17. Pre-Contract Information
17.1. We provide all pre-contract information required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including our identity, the main characteristics of the goods, and the total price including taxes.
